By accessing this website or booking services with Sarah Starkiss Photography, you agree to the following Terms & Conditions. If you do not agree, please discontinue use of this website immediately.

1. Ownership of Content

All photographs, text, graphics, logos, and all other content on this website are the exclusive property of Sarah Starkiss Photography.
Any unauthorised use—including copying, downloading, screenshotting, editing, or distributing—is strictly prohibited and may result in legal action.

2. Booking, Payments & Deposits

  • All bookings require a non-refundable deposit to secure the date.

  • No session is confirmed until the deposit is received.

  • The remaining balance must be paid before or on the day of the session.

  • Failure to pay will result in immediate cancellation of the session with no refund of the deposit.

  • ​

3. Cancellations & Rescheduling

  • Client cancellations: Deposits are non-refundable under all circumstances.

  • Rescheduling: Allowed once with a minimum of 48 hours’ notice, subject to availability.

  • Last-minute cancellations (less than 48 hours) may incur full session charges.

  • Photographer cancellation: If the photographer must cancel due to unforeseen circumstances, clients are entitled to a full refund or a rescheduled session—this is the maximum liability.

4. Copyright & Usage Rights

  • All images remain the copyrighted property of Sarah Starkiss Photography.

  • Clients receive a non-exclusive, non-transferable personal-use licence.

  • Images may not be sold, altered, filtered, heavily edited, or used commercially without written permission.

  • RAW/unedited images will never be released.

Photographer’s Rights:
Unless a written request is submitted before the session, the photographer may use images for portfolio, advertising, website, and social media.

5. Editing, Retouching & Artistic Control

  • Editing style and artistic direction are determined solely by the photographer.

  • Final galleries include only edited images selected by the photographer.

  • Additional or extensive retouching may incur extra fees.

  • Requests to re-edit images must be made within 7 days of delivery.

6. Image Delivery

  • Final images are delivered digitally within the timeframe provided at booking.

  • Delivery delays caused by technical issues, workload, weather, or unforeseen circumstances do not qualify for refunds.

  • The photographer is not liable for lost or deleted images once delivered to the client.

7. Client Responsibilities

The client agrees to:

  • Arrive on time and prepared.

  • Ensure all participants cooperate.

  • Provide accurate information when booking.

Lack of cooperation or late arrival may result in fewer images, and no refund will be issued.

8. Weather, Environmental Conditions & Outdoor Sessions

Outdoor sessions may be postponed due to unsafe or extreme weather conditions.
Rescheduling is at the photographer’s discretion.
Weather-related cancellations initiated by the client do not qualify for refunds.

9. Liability & Limitations

  • The photographer is not liable for injuries, loss, or damage to personal property during sessions.

  • In extreme circumstances (equipment failure, illness, data loss), liability is strictly limited to a reshoot or refund of the amount paid—no further compensation will be provided.

10. Print Products & Orders

  • All print and product orders are final.

  • Damaged or defective items will be replaced, not refunded.

  • Colour variations between screens and printed products are normal and do not qualify for refunds.

11. Privacy & Data Protection

Client information is used only for communication, invoicing, and booking purposes.
Details will never be sold or shared with third parties.

12. Amendments to Terms

These Terms & Conditions may be updated at any time without notice. Continued use of this website signifies acceptance of the updated terms.
